Rail authorities persist in shouldering the extra expenses associated with Stuttgart 21 project in court's ruling
The much-anticipated Stuttgart 21 rail project, which includes the construction of a new main railway station in Stuttgart and various tunnels, tracks, passages, bridges, and new railway stations, is set to see partial operation by the end of 2026.
The project, which also involves the construction of the high-speed line Wendlingen-Ulm, opened in 2022, has faced several hurdles, including legal disputes and cost overruns. The legal dispute revolved around the interpretation of a "talking clause" in the 2009 financing agreement, regarding cost increases.
The "talking clause" allowed for cost increases exceeding the initial €2.8 billion estimate by up to €1 billion. Under this clause, the State of Baden-Württemberg agreed to fund up to €780 million of these additional costs, while Deutsche Bahn (DB) would cover up to €220 million. This arrangement reflects a negotiated compromise on construction risk allocation after earlier difficulties in agreeing on cost responsibilities during negotiations in 2006-2007.
The need to phase in the operation of Stuttgart 21 is cited for easing closures required for connecting the new infrastructure to existing tracks. Construction on the project began in 2010, and the opening has been postponed several times.
By the end of 2026, long-distance and some regional traffic will start using the new underground station, while some regional traffic will continue to end at the old terminal station until July 2027. The heart of Stuttgart 21 is the new underground main station, which will be a through station unlike the current terminal station.
In the event of additional costs, the project partners had agreed to enter into discussions, as stated by the presiding judge in the Stuttgart court in May 2024. However, no obligation to negotiate or even a claim for contract adjustment can be derived from this clause, according to the court's view.
The phased operation of Stuttgart 21 is a significant step towards completing this ambitious project, which promises to modernise and improve the rail infrastructure in Stuttgart and the surrounding region.
