Nevada DEP Granted EPA Delegation to Streamline PSD Permits
The Nevada Division of Environmental Protection (DEP) has been granted a significant delegation by the EPA's Pacific Southwest Region 9. This move allows the DEP to handle Federal Prevention of Significant Deterioration (PSD) permits, treating them as federal permits rather than state ones.
Effective immediately, the DEP can issue PSD permits under 40 CFR 52.21, streamlining the process for both the agency and applicants. This delegation, finalised in January 2020, was agreed upon between the EPA and the DEP, although the specific individual who signed off on the agreement remains unidentified in public records.
The DEP's new authority will help manage PSD permits more efficiently, aligning with federal standards while reducing the workload for EPA Region 9. This change is expected to expedite permit approvals without compromising environmental protections.
