Customs official from Furth in the Forest declares self-employment status, now faces conviction as a business proprietor
In a significant ruling, the Regensburg Local Court has convicted Elektro Altmüller GmbH, a company based in the Cham district, for employing three installers as alleged self-employed workers from 2016 to 2021. The investigation, led by the Financial Control Black Work department of the Regensburg Main Customs Office, was conducted at the Furth im Wald site.
The company, which specialises in selling and installing metal systems, was found to have been saving around 165,000 euros in social security contributions over several years by not reporting the wages of its installers to the social security office. In reality, these workers were functioning like regular employees within the company.
The total wages of the installers amounted to almost 1.5 million euros. However, due to their pseudo-self-employment status, they may have lost out on pension or health insurance claims. The Regensburg Public Prosecutor's Office brought charges of withholding and misappropriation of wages against the company owner.
The company owner was sentenced to a total fine of 51,150 euros by the Regensburg Local Court. Moreover, they are required to pay the withheld social security contributions and court costs.
Wolfgang Braun, an investigator of the Financial Control Black Work, emphasised the importance of their work against pseudo-self-employment. He stated that such practices are considered unfair and hinder fairness in the labor market.
